Análisis de la reclamación núm. 3447 en el marco de la OIT: a propósito de la negociación colectiva, el derecho de huelga y la libertad sindical

Abstract

Este trabajo centra su atención en la reclamación núm. 3447, tramitada ante el Comité de Libertad Sindical (CLS) de la Organización Internacional del trabajo (OIT). A partir de ella, se analizan dos de las garantías más relevantes y protegidas en el ámbito de esta Organización: el derecho a la negociación colectiva y el derecho de huelga. En este contexto, este estudio adopta un enfoque jurídico procesal, orientado, por una parte, a dilucidar si las garantías mencionadas forman parte del contenido de la libertad sindical y, por otra, a examinar los argumentos planteados por la organización querellante.This paper focuses on complaint No. 3447, filed with the Committee on Freedom of Association (CFA) of the International Labour Organisation (ILO). Based on this complaint, it analyses two of the most frequently discussed and protected guarantees within the scope of this Organisation: the right to collective bargaining and the right to strike. In this context, this study adopts a procedural legal approach, aimed, on the one hand, at clarifying whether the aforementioned guarantees form part of the content of freedom of association and, on the other, at examining the arguments put forward by the complainant organisation.
