Abstract
El derecho de defensa se integra en la categoría de los derechos fundamentales de contenido procesal que se recogen en el artículo 24 CE. Sin embargo, su consideración, si cabe, va mucho más allá el formar parte del contenido de uno de los principios estructurales del proceso, el principio de contradicción. Su estudio ha sido constante en los últimos años. Con este artículo se intenta realizar una breve reflexión sobre su contenido a la luz de la LO 5/2024, de 11 de noviembre, que por primera vez aborda, con algunas deficiencias, una regulación específica del derecho. En esta tarea se desvincula, cuando menos teóricamente, de su adscripción al proceso, para extender su ámbito de aplicación a todas las controversias administrativas, a las diligencias practicadas por el Ministerio Fiscal y a los MASC. Después de una reflexión sobre la citada ley, el estudio se centra en el proceso penal analizando las diferentes manifestaciones de este derecho y su contenido.
The right of defense is included in the category of fundamental rights of procedural content, as set out in Article 24 of the Spanish Constitution. However, its consideration, if applicable, goes far beyond being part of the content of one of the structural principles of the process, the principle of contradiction. Its study has been constant in recent years. This article attempts to provide a brief reflection on its content in light of Organic Law 5/2024, of November 11, which for the first time addresses, albeit with some deficiencies, a specific regulation of the right. In this task, it is detached, at least theoretically, from its connection to the process, in order to extend its scope of application to all administrative disputes, actions carried out by the Public Prosecutor, and MASC (Alternative Dispute Resolution Methods). After a reflection on the aforementioned law, the study focuses on criminal proceedings, analyzing the different manifestations of this right and its content.
