Abstract
The Constitution of 1869 was referred for its development to a Law on the organization of Courts which, when it was promulgated in 1870, was as a provisional of the Judicial Branch. However, behind the façade that this nomenclature represented was always a law for the organization of courts that, because it was such and never from an independent political power, was able to prolong its validity for a little over a century and with divergent political regimes. Through the study of normative, parliamentary and doctrinal texts, the non-existence of an organically independent judicial branch can be demonstrated, but on the other side, the existence of an independent jurisdiction entrusted to judges and courts
