AB La Constitución de 1869 se remitió para su desarrollo a una Ley de organización de Tribunales que cuando en 1870 se promulgó lo fue como Ley provisional sobre organización del Poder Judicial. No obstante, detrás de fachada que representaba esa nomenclatura siempre fue una ley de organización de tribunales que, por ser tal y nunca de un poder político independiente, pudo prolongar su vigencia a lo largo de poco más de un siglo y con regímenes políticos divergentes. A través del estudio de textos normativos, parlamentarios y doctrinales, se demuestra la inexistencia de un poder judicial orgánicamente independiente, pero sí, por el contrario, de la existencia de una función judicial independiente encomendada a jueces y tribunales
AB The Constitution of 1869 was referred for its development to a Law on the organization of Courts which, when it was promulgated in 1870, was as a provisional of the Judicial Branch. However, behind the façade that this nomenclature represented was always a law for the organization of courts that, because it was such and never from an independent political power, was able to prolong its validity for a little over a century and with divergent political regimes. Through the study of normative, parliamentary and doctrinal texts, the non-existence of an organically independent judicial branch can be demonstrated, but on the other side, the existence of an independent jurisdiction entrusted to judges and courts
