Abstract
La regulación de las obligaciones administrativas examinadas, contenida en la Ley
45/1999, forma parte de la transposición que esta Ley hace de la Directiva 96/71/CE,
con cuyo art. 5 guarda relación. Sucede, sin embargo, que la materia se ha visto afectada
por la Directiva 2014/67/UE, que, a diferencia de la 96/71/CE, ofrece una determinación
abierta de las obligaciones de ese tipo y de las pautas de su elección y establecimiento por
las legislaciones nacionales. Ello conduce a que aquella regulación sea hoy insatisfactoria
y precise ciertas modificaciones que la adapten a las previsiones de la nueva Directiva y,
en definitiva, la transpongan de modo suficiente y eficiente. Es conveniente que tal transposición,
que se produciría ya fuera de plazo, valore la conveniencia de incorporar otras
medidas de control cuya posible introducción contempla la referida Directiva y precise
mejor, dentro de lo permitido por ésta y teniendo en cuenta los criterios mantenidos por
el Tribunal de Justicia, las dos obligaciones que aparecen en la Ley 45/1999. Ello es más
necesario, si cabe, en relación con la obligación de comparecencia y aportación de documentación,
definida en términos que cabría considerar que exceden de lo que la Directiva
2014/67/UE considera buena práctica nacional al respecto.
The regulation of administrative obligations that are examined is included in Law 45/1999 and is part of the transposition that this law does to Directive 96/71/EC, whose art. 5 relates. Nevertheless, this matter’ has been affected by Directive 2014/67/EU, which unlike 96/71/EC, offers an open determination about this kind of obligations and the guidelines for its election and implementation by national legislations. This means that the referred regulation is unsatisfactory nowadays and needs some amendments to fit into the provisions of the new Directive and, all in all, is transposed in a sufficient and efficient way. It seems convenient that such transposition, which would happen after the deadline, considers the convenience of adding other kind of control measures whose potential introduction is already considered within the limits of the referred Directive and better defines both obligations that are included in Law 45/1999 as far as it is permitted by it and taking the criteria of the Court of Justice into account. This is even more necessary, if possible, in relation to the obligation of appearance in Court and submission of documentation, defined in terms that might surpass what the Directive 2014/67/EU considers as good national practice on this matter.
