Análisis de sentencias en agresiones sexuales múltiples

Abstract

La investigación en torno a la agresión sexual en grupo empieza a cobrar una mayor importancia en los últimos años, no sólo por las dinámicas particulares del fenómeno sino también por la alarma social que generan los medios de comunicación sobre ciertos casos, como el de La Manada. El objetivo de este trabajo es analizar el modus operandi de las agresiones sexuales múltiples y las características de los agresores, así como estudiar el perfil y las consecuencias psicológicas para las víctimas de este delito. Además, se ha considerado relevante conocer qué medios de prueba, incluidas las periciales psicológicas, son tenidos en cuenta por el sistema judicial a la hora de valorar el hecho delictivo. Para ello, se seleccionaron aleatoriamente 82 sentencias penales de juicios realizados en los últimos diez años de agresiones sexuales en grupo a mujeres, con independencia de su edad. Se llevó a cabo un análisis en el que se incluyen pruebas como el estadístico Chi-cuadrado para estudiar la relación entre las variables de interés. Los resultados consiguen reflejar de una manera global el fenómeno de la violación grupal, encontrando relaciones significativas entre el tamaño del grupo, la relación previa entre la víctima-agresores, la ausencia de resistencia activa durante la agresión y las consecuencias psicológicas en la víctima, entre otras. Se concluye la necesidad de introducir programas de prevención temprana de cara a evitar la aparición de este tipo de conducta delictiva, y aplicar medidas de protección con enfoque en Justicia Terapéutica para proteger a la víctima de las consecuencias negativas del proceso judicialThe investigation around group sexual assault begins to take on greater importance in recent years, not only because of the particular dynamics of the phenomenon but also because of the social alarm generated by the media about certain cases, such as “La Manada”. The objective of this work is to analyze the functioning of multiple sexual assaults and the characteristics of the aggressors, as well as to study the profile and psychological consequences for the victims of this crime. In addition, it has been considered relevant to know what means of evidence, including psychological expertise, are taken into account by the judicial system when assessing the criminal act. To do this, 82 criminal sentences were randomly selected from trials conducted in the last ten years of group sexual assaults on women, regardless of their age. An analysis was carried out in which tests, such as the Chi-square statistic, are included to study the relationship between the variables of interest. The results manage to reflect in a global way the phenomenon of group rape, finding significant relationships between the size of the group, the previous relationship between the victim-aggressors, the absence of active resistance during the aggression and the psychological consequences in the victim, among others. It concludes the need to introduce early prevention programs in order to avoid the appearance of this type of criminal behavior, and to apply protection measures with a focus on Therapeutic Justice to protect the victim from the negative consequences of the judicial process
