Abstract
El presente trabajo examina los principales problemas que genera para el Derecho de marcas el creciente fenómeno de los tokens no fungibles. Tras la exposición del concepto de NFT, se presta atención al registro de marcas para distinguir los tokens no fungibles (con especial atención a la determinación de los productos o servicios distinguidos por la marca y al requisito del carácter distintivo). Posteriormente se analizan los supuestos de infracción de marcas ajenas por medio de NFTs, tanto de marcas registradas específicamente para distinguir tokens no fungibles como de marcas registradas para otro tipo de productos o servicios.
This paper examines the main problems generated for trademark law by the growing phenomenon of nonfungible tokens. First, we explain the NFT concept. Then we focus on trademark registration to distinguish non-fungible tokens (with special attention to the identification of products or services distinguished by the trademark and the requirement of distinctiveness). Subsequently, the cases of infringement of trademarks through NFTs are analyzed, both of trademarks specifically registered to distinguish non-fungible tokens and of trademarks registered for other types of products or services.
