Diseño industrial y estampado de prendas de vestir

Abstract

Al hilo de un reciente pronunciamiento del Tribunal Supremo español se examinan los problemas que se suscitan, en relación con los requisitos de novedad y carácter singular en materia de diseño industrial, cuando se aplica un mismo estampado a dos prendas de vestir diferentes.This paper comments a recent judgment of the Spanish Supreme Court on industrial design law and in connection with that the problems that arise, in relation to the requirements of novelty and singular character, when the same pattern is applied to two different garments.
