El delito de maltrato habitual: características sociodemográficas, penales y criminológicas

Abstract

El presente trabajo tiene por objeto el análisis empírico del delito de maltrato habitual (art. 173.2 CP). Para ello hemos seleccionado y tratado la información procedente de los expedientes de la Fiscalía de Área de Santiago de Compostela relativos a este delito que concluyeron con sentencia firme, durante los años 2005 a 2012 (en total 102 casos). Principalmente se abordan las variables sociodemográficas de la víctima y del agresor, las características de la relación de pareja, los criterios definitorios de la «habitualidad» –en tanto que elemento esencial del tipo– y su contexto comisivo.The aim of this work is to analyze empirically the habitual mistreatment crime. For it we have selected and treated the information extracted from the files of the District attorney’s office of Santiago de Compostela relative to this crime which concluded with final judgement from 2005 to 2012 (in total 102 cases). This paper focuses mainly on sociodemographic variables of the victim and the aggressor, the characteristics of the intimate relationship, the defining criteria of the term «habitual» –essential element of this offence– and the context of the crime.
