«Me quiere matar en el mar»: una ejecución por ahogamiento en Galicia (1220)

Abstract

En la Edad Media se utilizaron diferentes métodos de ejecución en medio judicial. Algunos como la pena capital por ahogamiento o del saco (poena cullei) tuvieron un largo alcance temporal desde la Roma arcaica hasta la recuperación del derecho romano en el siglo XIII y más allá. En este artículo se analizará una ejecución por ahogamiento en Galicia en 1220 que constituye un caso único hasta el momento en la documentación medieval gallega. Normalmente la investigación sobre las formas de tortura y ejecución posee un nivel de irrealidad vinculada con su dimensión teórica y procesal. Sin embargo, esta investigación presenta además del desarrollo genealógico de esta pena en la Península Ibérica, su pervivencia jurídica, histórica o erudita y su posible aplicación práctica en un caso de ejecución documentada durante el reinado de Alfonso IX de Galicia y León (1171-1230). Las dos dimensiones de la investigación (la teórica y la práctica) ayudarán a comprender mejor el funcionamiento y aplicación de la pena de muerte, la memoria social del castigo y la implicación de agentes locales y familiares en un área concreta

In the Middle Ages, different methods of execution were used in judicial proceedings. Some, like capital punishment by drowning or «of the sack» (poena cullei), were used for a long period from archaic Rome to the recovery of Roman law in the thirteenth century and beyond. This study will analyse an execution by drowning in Galicia in 1220, which constitutes a unique case thus far in Galician medieval documentation. Normally, research on forms of torture and execution often succumbs to the distortion of reality as it follows too strictly its theoretical and procedural dimension. However, this study presents not only the genealogical development of this punishment in the Iberian Peninsula, but also its legal, historical or scholarly survival and its possible practical application in a documented case of execution during the reign of Alfonso IX of Galicia and Leon (1171-1230). The two dimensions of the research (theoretical and practical) will help to better understand the functioning and application of the death penalty, the social memory of the punishment and the involvement of local and family agents in a specific area
