El derecho social de la Unión Europea en la encrucijada: entre la parálisis legislativa y el impulso judicial

Abstract

El propósito de este trabajo es poner de manifiesto el impasse en el que se encuentra en este momento el modelo social de la Unión Europea. Con este objetivo, se examinará la actual parálisis en la creación normativa y se considerará el Brexit como un amago de retroceso social. El escaso papel del Parlamento Europeo también será puesto de manifiesto. En ese lánguido escenario, la atención pasará a continuación al Tribunal de Justicia, con dos puntos de vista complementarios. En primer lugar, se abordará su rol en estos momentos, para a continuación hacer un breve estudio de caso, las conocidas sentencias de septiembre de 2016 y su impacto, todavía no definitivo, en la doctrina judicial españolaThe aim of this paper is to show the impasse that it is nowadays the EU Labour Law. With this goal, the current paralysis in normative creation will be examined and Brexit will be considered from the point of view of a social setback. The tiny role of the European Parliament will also be shown. In this languid scenario, the attention will move to the European Court of Justice, with two complementary approaches. First, its role in these moments will be considered, to make afterward a brief case study, the well– known decisions of September 2016 and its impact, not yet final, in the Spanish judicial doctrine.
