El concepto de inventor en el derecho de patentes y los sistemas de inteligencia artificial

Abstract

Los extraordinarios desarrollos alcanzados en el campo de la inteligencia artificial determinan la necesidad de revisar aspectos asentados en el Derecho de patentes, entre ellos, la posibilidad de que se pueda reconocer la calidad de inventor a un sistema de inteligencia artificial. En el presente trabajo se examinan los retos que plantea esta cuestión a la luz de la normativa española de patentes y del Convenio sobre concesión de Patentes Europeas. En concreto, se hace un análisis de la figura del inventor en la normativa vigente para, a partir de este, valorar la necesidad o no de modificar la normativa actual para adaptarse a las expectativas suscitadas por la capacidad inventiva de los sistemas de inteligencia artificial.

The rocketed developments in artificial intelligence field make necessary to review some topics on Patent Law, specially the concept of inventorship in order to asses if an artificial intelligence system can be considered as inventor. This paper examines this problem in the Spanish and European Law. Taking into account the analysis of the legal concept of inventor, we examine whether it is necessary to change the regulation to adapt it to the new challenges of the inventive capacity of the artificial intelligence systems.
