Acerca del método híbrido o med-arb: otra forma de resolver los conflictos

La apuesta por vías alternativas o complementarias al proceso judicial en ningún caso implica rehuir o dejar de lado la utilización del mismo. Y ello porque la idea de Justicia global del siglo XXI pasa por ofrecer al justiciable un buen sistema de gestión y solución de conflictos, el cual será mejor en tanto ofrezca diversas opciones en orden a seleccionar la que considere más adecuada. Entre estas opciones, destaca el método med-arb como una fórmula híbrida de solventar los conflictos, en la cual se combina la utilización de un medio autocompositivo con otro heterocompositivo.The commitment to alternative or complementary avenues to the judicial process in no way implies avoiding or disregarding the use of the latter. This is because the idea of global justice in the 21st century involves offering litigants a good system for managing and resolving conflicts, which will be better insofar as it offers various options from which to select the one considered most appropriate. Among these options, the med-arb method stands out as a hybrid formula for resolving conflicts, combining the use of a self-composing means with a hetero-composing one.
