Análisis psicosocial de sentencias judiciales en casos de pornografía infantil

Abstract

La pornografía infantil es considerada una forma de maltrato infantil y de agresión sexual; es un delito que se comete a través del entorno digital, ya sea almacenando contenido sexual de menores, distribuyéndolo por redes y/o elaborándolo. En España, durante el año 2021 se resgistraron un total de 739 de estos delitos. Para las víctimas esto supone, no solo las consecuencias de sufrir un abuso sexual, si no también consecuencias del propio delito de ser víctima de pornografía. El objetivo de este trabajo es conocer la situación delictiva de este crimen en nuestro país, especialmente las carcaterísticas de los agresores y de las víctimas, así como las medidas legales aplicadas. Para ello, se seleccionaron al azar 100 sentencias judiciales entre el año 2019 y 2023 que recogían un delito de pornografía infantil. Además, se realizó un análisis categorial metódico usando el estadístico Chi cuadrado para establecer la relación entre variables. Los resultados obtenidos permitieron conocer las medidas legales dictaminadas, la protección concedida a las víctimas durante el juicio, el método de captación de menores en función del vínculo víctima-agresor, el empleo del engaño como medio para delinquir, el perfil de los agresores y las consecuencias causadas a las víctimas. Para finalizar, se concluye la importancia de seguir investigando sobre estos delitos dadas las características de Internet, anónimo y descentralizado, que permite que se perpetuen de forma protegida para los ofensores, así como llevar a cabo un tratamiento efectivo tanto para agresores como para víctimas

Child pornography is currently considered a form of child abuse, as well as sexual assault; it is a crime committed through the digital environment either by collecting sexual content of minors, distributing it through networks and/or producing it. A total of 739 such crimes were registered in Spain in 2021. For minors, this means not only the consequences of suffering sexual abuse, but also the consequences of being a victim of pornography. The aim of this work is find out about the criminal situation of this offense in our country, especially the characteristics of the aggressors and the victims, as well as the legal measures applied. For this purpose, 100 sentences were randomly selected from criminal trials between 2019 and 2023 that included a child pornography offence in the judgement. In addition, a methodical categorical analysis was carried out using the Chi-square statistic for the relationship between variables. The results obtained allowed us to know the legal measures imposed, the protection granted to the victims during the trial, the method of recruiting minors in relation to the victim-offender vehicle, the use of deception as a means to commit the offence, the profile of the aggressors and the consequences caused to the minors. Finally, we conclude that it is important to continue researching these crimes due to the characteristics of the Internet, anonymous and decentralised, which allows crimes to be perpetuated in a protected way for the perpetrators, as well as to carry out effective treatment for both aggressors and victims
