Abstract
La edad es una característica objetivamente mensurable con fundamento en la cual se ha presumido la mayor o menor vulnerabilidad, capacidad o experiencia de una persona. Sin embargo, esta presunción no siempre ha sido sustentada sobre evidencias científicas, sino sobre el ideal que una sociedad se había forjado. Surge, así, el «edadismo» o diferencia de trato por razón de edad, basada, no en un hecho biológico, sino en un estereotipo. Aunque la Constitución española de 1978 incluyera la edad entre las causas, no de desigualdad, sino de discriminación, los prejuicios asociados a ella condicionan todavía el acceso, la promoción y la conservación del empleo. Y, comoquiera que este prejuicio convive en el imaginario popular con otros muchos, interesa abordarlo en combinación con el que aflige a un mayor número de personas trabajadoras. Procede, por consiguiente, analizar la discriminación derivada de la intersección de dos condiciones, cuales son la edad y el género, considerando la vis atractiva y transformadora de esta última. Ello implica identificar y clasificar sus diversas variantes, para luego cuestionar, con ánimo propositivo, el nuevo marco jurídico llamado a prevenirla, erradicarla y sancionarla.
Age is an objectively measurable characteristic based on which a person's greater or lesser vulnerability, capacity or experience has been presumed. However, this presumption has not always been supported by scientific evidence, but on the ideal that a society had forged for itself. Thus, “ageism” or difference in treatment on the grounds of age, based not on a biological fact, but on a stereotype, has arisen. Although the Spanish Constitution of 1978 included age among the causes, not of inequality, but of discrimination, the prejudices associated with it still condition access, promotion to and job retention. And, since this prejudice coexists in the popular imagination with many others, it is interesting to address it in combination with the one that affects a greater number of working people. It is therefore necessary to consider the discrimination derived from the intersection of two conditions, age and gender, taking into account the attractive and transforming force of the latter. This implies identifying and classifying its various variants, in order to then question, with a proactive spirit, the new legal framework called upon to prevent, eradicate and punish intersectional discrimination.
