Abstract
La convivencia dentro de un centro penitenciario presenta unas características que influyen negativamente en la interrelación personal, lo que genera una alta conflictividad. Ello, no obstante, aunque las soluciones institucionales neutralizan temporalmente el conflicto, este tipo de intervención no entra a conocer sus causas, sino la formalización de este, impidiendo soluciones dialogadas, disminuyendo las posibilidades de reparación y reconocimiento del daño y potenciando una reacción posterior de venganza. Por tal motivo, se pretende demostrar la viabilidad de la mediación en el ámbito penitenciario, en tanto representa un método de resolución pacífica de conflictos entre internos, basado en el diálogo y el respeto, posibilitando a las personas implicadas asumir la responsabilidad de su conducta, el protagonismo en el procedimiento y en la propia resolución del conflicto.
Para ello, se analiza la Justicia restaurativa como un modelo de Justicia que permite el cambio de paradigma en el Derecho penal español, en tanto pretende restaurar la paz social a través de la participación de las partes en la gestión de las controversias. En este escenario, cabe destacar la mediación como mecanismo alternativo de resolución de conflictos que, si bien es adecuada para solventar disputas en cualquier ámbito, lo cierto es que representa más que un método eficaz para aquellas que surgen en el ámbito de un centro penitenciario en el que, por sus características y particularidades, se hace más que preciso un método de este tipo que posibilite la gestión positiva de los conflictos surgidos en el mismo. Por tal motivo, y para finalizar este trabajo, se lleva a cabo un análisis de como es posible incorporar la mediación en el ámbito penitenciario
The coexistence within a penitentiary center presents some characteristics that negatively influence the personal interrelation, which generates a high level of conflict. However, although institutional solutions temporarily neutralize the conflict, this type of intervention does not come to know its causes, but the formalization of it, preventing dialogue solutions, reducing the possibilities of reparation and recognition of damage and promoting a subsequent reaction of revenge. For this reason, it is intended to demonstrate the viability of mediation in the prison environment, as it represents a method of peaceful resolution of conflicts between inmates, based on dialogue and respect, enabling the persons involved to take responsibility for their conduct, the protagonism in the procedure and in the resolution of the conflict itself. To this end, restorative justice is analyzed as a model of justice that allows the change of paradigm in Spanish criminal law, in so far as it seeks to restore social peace through the participation of the parties in the management of disputes. In this context, mediation should be highlighted as an alternative dispute resolution mechanism which, while adequate to resolve disputes in any field, the fact is that it represents more than an effective method for those which arise in the context of a prison in which, because of its characteristics and particularities, such a method is more than necessary to enable the positive management of conflicts arising there. For this reason, and in order to complete this work, an analysis is carried out of how mediation can be incorporated in the prison environment
