Abstract
Las recientes sentencias del Tribunal de Justicia en el ámbito del despido colectivo han puesto de manifiesto los desajustes existentes entre la regulación ofrecida por la Directiva 98/59/CE y la inadecuada transposición realizada por el art. 51 ET. Hasta el momento, los órganos judiciales han tratado de solventar, en la medida de sus posibilidades, estos desacuerdos normativos. Para ello, los tribunales nacionales han realizado un importante ejercicio de interpretación conforme pues, hasta el momento, la pasividad del legislador ha dejado en sus exclusivas manos la determinación de conceptos tan relevantes para esta materia como qué ha de entenderse por despido, o la necesidad de atender al centro de trabajo como unidad de cómputo respecto del número de extinciones.
Abstract: The most recent cases of the European Court of Justice about collective redundancies have shown important disagreements between Directive 98/59/EC and the inadequate transposition made by art. 51 ET. Until now, courts have tried to resolve, as far as they can, these legal maladjustments. In order to this, courts have made a remarkable imple¬mentation of the principle of conforming interpretation because of the legislator’s pas¬sivity, which has left to courts the determination of such relevant concepts as what does dismissal mean, or the need to consider the workplace as a measuring unit in order to calculate the number of contract terminations.
