Abstract
El acercamiento interdisciplinario más reciente al fenómeno de la menstruación ha acuñado el término salud menstrual. Este concepto ha entrado en la legislación laboral principalmente a través de la institución de la baja menstrual. En este artículo se realiza una investigación comparativa basada en la bibliografía y jurisprudencia internacional sobre la salud y el permiso menstruales. Es imprescindible el acercamiento a este fenómeno para una legislación laboral sostenible, ya que la salud menstrual afecta a la legislación laboral, vinculándose a unas condiciones de trabajo justas y decentes. A nivel internacional no existe una solución jurídica común, si bien es una cuestión con relevancia global, hasta la fecha cuenta con muy limitados acercamientos jurídicos. Recent interdisciplinary approaches to the phenomenon of menstruation have coined the term menstrual health. This concept has entered labour legislation mainly through the institution of menstrual leave. In this article a comparative research based on international bibliography and jurisprudence on menstrual health and menstrual leave is carried out. An approach to this phenomenon is essential for sustainable labour law, as menstrual health affects labour law not only from the perspective of fundamental rights, but also to achieve equal treatment, linked to fair and decent working conditions. At the international level there is no common legal solution, although it is an issue with global relevance, to date it has very limited legal approaches. The aim of this study is to highlight the need to regulate menstruation in labour legislation.
