Los regímenes económicos matrimoniales en el derecho común

Abstract

El presente trabajo tiene por objeto estudiar las distintas fórmulas jurídicas existentes dentro del derecho nacional en relación con los regímenes económicos matrimoniales e investigar acerca de la visión jurisprudencial existente al respecto. Se busca concluir si la legislación vigente se adapta a la nueva estructura social, al valor cambiante que tiene el matrimonio en las nuevas generaciones y a la aparición de las parejas mixtas. La regulación del régimen económico matrimonial es heterogénea en nuestro territorio, por un lado, nos encontramos con lo que podemos denominar Derecho Civil Común, donde ubicamos el Código Civil, y, por otro lado, nos encontramos con el Derecho foral desarrollado por ciertas Comunidades Autónomas. En el presente estudio, centraremos nuestra atención en el Derecho Civil Común, sin olvidar, en ningún momento aquellas regulaciones anejas a éste. Desde la promulgación del Código Civil en 1889, el Derecho de familia ha sufrido diversas modificaciones consecuencia de la aparición de nuevos textos legislativos en materia de igualdad y libertad de la persona dentro de esta rama. Para el tema que nos atañe, son de vital importancia: Ley 14/1975 de 2 de mayo, Ley 11/1981 de 13 de mayo, Ley 13/2005 de 1 de julio y Ley 15/2015 de 2 de julio. En definitiva, el trabajo trata de aportar a través de una visión teórica si el sistema permite a las personas contrayentes pactar el régimen económico más favorable o, por el contrario, la fórmula planteada por el Código perjudica a las partes cuando éstas son desconocedoras de las diversas opciones por las que pueden decantarse.

The purpose of this academic work is to study the different legal formulas existing within national law according to matrimonial property regimes and to investigate the existing jurisprudential vision. The aim is to conclude if the current legislation is adapted to the new social structure, to the changing value of marriage in the new generations and to the appearance of mixed couples. The regulation of the matrimonial economic regime is heterogeneous in our territory, on one hand, we find what we can call Common Civil Law, where we place the Civil Code, and, on the other hand, we find the Regional Law developed by certain Autonomous Communities. In the current study, we will focus our attention on the Common Civil Law, without forgetting, anyway, those regulations attached to it. Since the enactment of the Civil Code in 1889, family law has suffered several modifications as a result of the appearance of new legislative texts according to equality and freedom of the person within this branch. For the issue that concerns us,they are of vital importance: Law 14/1975 of May 2, Law 11/1981 of May 13, Law 13/2005 of July 1 and Law 15/2015 of July 2. Therefore, the work tries to contribute through a theoretical vision if the system allows the contracting parties to agree the most favorable economic regime or, on the contrary, the formula proposed by the Code harms the parties when they are unfamiliar with the various options by which they can opt.
