Abstract
Los derechos fundamentales constituyen el
núcleo de la actual teoría de la Constitución (y de
la teoría del Derecho actual) porque son la parte
de la Constitución de mayor aplicación práctica.
Esto ha sido, a su vez, la causa del auge del estudio
de la interpretación constitucional y explica
también, en parte, el desarrollo del Derecho Procesal Constitucional. De ahí que la evolución
de los derechos fundamentales, especialmente en
aspectos como el de la naturaleza jurídica de los
derechos o su eficacia transnacional, sea objeto
de desarrollos también en el Derecho Procesal
Constitucional, que ha desarrollado técnicas
como la responsabilidad objetiva del Estado, el
establecimiento de órganos de protección
objetiva de los derechos fundamentales, el
“margen nacional de apreciación” en los procesos
internacionales yplantee elretode cómogarantizar
la eficacia transnacional de estos derechos.
The fundamentalrights constitute the core ofthe present Theory of the Constitution (and of the nowadays Theory of Law) because they are the more implemented section of the Constitution. This has been the source of the increasing interest in the constitutional interpretation and also explains the development of the Constitutional Procedural Law. This is why the evolution of the fundamental rights specially regarding their legal nature and their transnational effects are also subjects developed by the Constitutional Procedural Law that has created some tools as the responsibility of the State, the establishment of organs for the objective protection of the fundamental rights, the “national margin of appreciation” in international procedures and poses the challenge of how to guarantee the transnational effectiveness of those rights.
