AB Los derechos fundamentales constituyen elnúcleo de la actual teoría de la Constitución (y dela teoría del Derecho actual) porque son la partede la Constitución de mayor aplicación práctica.Esto ha sido, a su vez, la causa del auge del estudiode la interpretación constitucional y explicatambién, en parte, el desarrollo del Derecho Procesal Constitucional. De ahí que la evoluciónde los derechos fundamentales, especialmente enaspectos como el de la naturaleza jurídica de losderechos o su eficacia transnacional, sea objetode desarrollos también en el Derecho ProcesalConstitucional, que ha desarrollado técnicascomo la responsabilidad objetiva del Estado, elestablecimiento de órganos de protecciónobjetiva de los derechos fundamentales, el“margen nacional de apreciación” en los procesosinternacionales yplantee elretode cómogarantizarla eficacia transnacional de estos derechos.
AB The fundamentalrights constitute the core ofthepresent Theory of the Constitution (and of thenowadays Theory of Law) because they are themore implemented section of the Constitution.This has been the source of the increasinginterest in the constitutional interpretationand also explains the development of theConstitutional Procedural Law. This is whythe evolution of the fundamental rightsspecially regarding their legal nature andtheir transnational effects are also subjectsdeveloped by the Constitutional ProceduralLaw that has created some tools as the responsibility of the State, the establishmentof organs for the objective protection of thefundamental rights, the “national margin ofappreciation” in international procedures andposes the challenge of how to guarantee thetransnational effectiveness of those rights.
