AB La pretendida división de poderes que recogieron los textosconstitucionales españoles decimonónicos contrasta con la realidad. Laprevalencia del ejecutivo en los procedimientos legislativos de iniciativa ydelegación y el continuo empleo de disposiciones infralegales, le permitió, en elámbito judicial, asumir la redacción de los textos por los cuales se reguló elenjuiciamiento civil y el penal, así como controlar el estatuto de jueces ymagistrados. Estos fueron considerados empleados públicos, sometidos alMinisterio de Gracia y Justicia, de modo que, en realidad, los tribunales noconstituyeron en lo orgánico ningún poder al estar sujetos al ejecutivo -cualquiera que fuera su ideología-, mientras que en lo funcional sí desempeñaronla potestad de aplicar las leyes en los juicios civiles y criminales con notableindependencia.
AB The alleged division of powers that is reflected in the Spanishconstitutional documents of the nineteenth-century contrasts with reality. Theprevalence of the executive in the legislative procedures of the initiative and thedelegation and the continuous use of the infralegal provisions, permitted, in thejudicial sphere, assuming the writing of the texts by which the civil and criminalprosecution was regulated, as well as controlling the judges and magistrates.These were considered public employees, that are subject to the Ministry of Graceand Justice, so that, in reality, the courts did not constitute in the organic anypower as to be subject to the executive, whatever their ideology was, whilefunctionally they executed the power to apply the laws in civil and criminal trialswith remarkable independence.
