AB El contenido de la STC, 1ª, 27.04.10 (RJ 9/2010; MP: Javier Delgado Barrio) manteniendo que los Tribunales inferiores habían incurrido en violación del principio de igualdad al interpretar una cláusula testamentaria a favor únicamente de los hijos biológicos en perjuicio de los adoptivos es el punto de partida de este artículo.Por un lado, se trata de poner de manifiesto que el litigio carecía de contenido constitucional puesto que la igualdad entre hijos biológicos y adoptivos procede de la ley y no de la Constitución; y por otro lado, al hilo de la Sentencia y su voto particular, se plantea si el derecho de libertad dispositiva mortis causa puede ser limitado por otros derechos fundamentales como el de igualdad.
AB In Judgement of 27th April 2010 the Constitutional Spanish Court sustained that lower Courts, interpreting a testamentary clause that included only the biological offspring, had committed a break of the principle of equality.This article tries, on the one hand, to demonstrate that the issue lacks constitutional relevance, as the equality between biological and adoptive offspring is a legal requirement yet not a constitucional one. On the other hand, it explores the question of whether testamentary freedom can be limited by other rights, and in particular, by the principle of equality.
