AB L’approche de l’Union européenne au Sahara occidental s’est développée à partir de plusieurs perspectives, grâce à plusieurs institutions, à différentes périodes. Le Parlement européen s’est d’abord intéressé à la question du statut du territoire pour prêter davantage d’attention aux droits de l’homme dans une phase ultérieure et pour ensuite négliger le conflit. La Cour de justice de l’Union européenne a elle été saisie d’affaires qui ont abouti à d’importants arrêts. Mais si dans un premier temps une chambre de la Cour a pu régler l’affaire en s’appuyant sur les droits fondamentaux, la grande chambre a ensuite tranché la question en faisant appel au statut du territoire d’après les normes du droit international.
AB The European Union’s approach to the Western Sahara has developed from several perspectives, arising from a number of institutions at various moments in time. At first, the European Parliament considered the question of the status of the territory and then focused more on the human rights issue at a later stage but then ignored the conflict. Whereas the European Court of Justice has dealt with a number of cases that have led to important judgements. But if, at first, a chamber of the European Court of Justice gave a ruling based on fundamental rights, the Grand Chamber subsequently settled the issue by referring to the status of the territory according to the norms of international law.
