AB La contención de la pandemia mediante ha acelerado el éxodo de los trabaja-dores hacia un entorno privado. Con su retorno al ámbito del que habían partido durante la Primera Revolución Industrial, regresan aquellas amenazas que el Derecho del Trabajo supo afrontar durante el pasado siglo. Preocupa, en particular, el auge de la autonomía de la voluntad como fuente reguladora de los derechos y obligaciones del trabajador del cual da testimonio el papel que el RDley 28/2020, de 22 de septiembre, de trabajo a distancia, otorga al acuerdo de trabajo a distancia. De su análisis cabrá deducir la suficiencia de los contrapesos previstos por el ordenamiento jurídico para poner coto al predominio de una libertad contractual susceptible de derivar en la imposición de condiciones leoninas al trabajador.
AB The  containment  of  the  pandemic  has  accelerated  the  exodus  of  workers  to a private environment. With their return to the sphere from which they had departed during the First Industrial Revolution, those threats that labour law was able to deal with in the last century are returning. Of particular concern is the rise of the party autonomy as a regulatory source of the rights and obligations of the worker, as witnessed by the role that RD Law 28/2020 of 22 September on distance working gives to the distance working agreement. From its analysis, it can be deduced whether the counterweights provided for by the legal system are sufficient to put an end to the predominance of contractual free-dom that can lead to the imposition of unfair conditions on the worker.
