Abstract
O peso económico das vivendas de uso turístico medrou exponencialmente no último lustro da man do auxe da denominada economía colaborativa. O obxecto do presente traballo é analizar a problemática xurídica xurdida nesta materia. Existe un conflito competencial entre as distintas Administracións para regular a actividade, e esa mesma diversidade competencial provoca que non haxa un concepto unitario de vivenda de uso turístico en España. Xunto a isto, este traballo presenta un estudo sistemático e detallado da regulación material das vivendas de uso turístico en Galicia e a posición dos Tribunais respecto a esta normativa. A influencia da Directiva europea de servizos na materia queda reflectida ó longo de todo o traballo. Ademais, existen tratamentos normativos a nivel municipal que pretenden dar resposta a un conflito en crecemento e onde a resposta das Administracións é dispersa malia o tamaño do problema e o seu impacto na vida urbana.
The economic weight of short-term touristic rentals has grown exponentially during the past few years due to the boom of the peer-to-peer economy. The purpose of this project is to analyze the legal issues arising from this phenomenon. The jurisdictional conflict among different regulators leads to the absence of a unified definition of touristic rental in Spain. The project as well presents a systematic, in-depth study of the substantive regulation of short-term touristic rentals in Galicia and of the courts’ rulings on the matter. The influence of the relevant EU Directive on services in the internal market is displayed during the entire project. In addition, there are municipal-level approaches that attempt to address the growing conflict, which result in inconsistent solutions in spite of the scope of the problem and its impact on city life.
