El pacto de mejora en la Ley de Derecho Civil de Galicia : (cuestiones controvertidas)

Abstract

En el presente Trabajo Fin de Grado se realiza el estudio de algunos problemas jurídicos especialmente relevantes del pacto de mejora. Es esta una forma de delación hereditaria propia del derecho civil de Galicia que se usa con mucha frecuencia para transmitir en vida bienes y derechos a los descendientes, por gozar de una serie de beneficios fiscales que la hacen enormemente atractiva. Este pacto sucesorio está escuetamente regulado en la Ley de Derecho Civil de Galicia 2/2006y, a día de hoy, existen numerosas cuestiones controvertidas en relación al mismo, muchas delas cuales todavía no han sido resueltas por la jurisprudencia. A lo largo del presente trabajo se analizan problemas de derecho internacional privado o de derecho interregional, los bienes y derechos susceptibles de ser objeto del pacto de mejora, y sus efectos una vez abierta la sucesión del mejorante, en relación con la colación, computación e imputación o los supuestos de ineficacia del pacto. Para ello se examina tanto la legislación como la doctrina y jurisprudencia existentes y se proponen algunas soluciones.

In the present End of Degree Assignment, the study of some really relevant legal problems of the improvement agreement is carried out. This is a form of hereditary denunciation typical of Galician Civil Law that is very often used to transfer in life assets and rights to the descendants, as it enjoys a series of tax benefits that make it enormously attractive. This agreement as to succession is tersely regulated in Galician Civil Law 2/2006 and, nowadays there are many controversial issues in relation to it, many of which have not been resolved by case law yet. Throughout this paper we analyze problems of private international law or interregional law, the assets and rights that can be subject to the improvement agreement, and its effects once opened the succession of the improvement, in relation to the collation, computation and imputation or the assumptions of ineffectiveness of the agreement.To this end, an analysis will be made of existing legislation, doctrine and case law, and some solutions will be proposed.
