"Iustum matrimonium" e "ius conubii". Las uniones matrimoniales y el derecho de los latinos

Abstract

El presente artículo pretende esclarecer la cuestión de los derechos matrimoniales de los Latini en época altoimperial, ya sean junianos o los que aquí denominaremos provinciales. Dicha tarea la realizaremos analizando la cuestión del ius conubii y su posible inclusión dentro de los derechos o capacidades propias de la latinidad, pero también poniendo especial interés en los mecanismos de promoción exclusivos de su status jurídico –a saber, el ius Latii y la anniculi probatio– y de sus efectos en las uniones matrimoniales previas. Con esto trataremos de demostrar la existencia de un elemento en común entre ambos tipos de latinos: un afán integradorThis article aims to clarify the issue of the marriage rights of the Latini during the Early Principate, wheter Junian Latins or those who we will call here provincials. We will carry out this task analyzing the issue of the ius conubii and its possible inclusion within the rights or capabilities of Latinitas, but also placing special interest in the promotion mechanisms exclusive of its legal status –namely, the ius Latii and anniculi probatio– and its effects on previous marriages. With this we will try to demonstrate the existence of a common element between both types of Latin people: an integrative will.
