Abstract
El desarrollo de la actividad eólica en Galicia ha estado caracterizado, entre otros elementos, por una remuneración “controvertida” del terreno ocupado por los parques eólicos. Esta controversia se ha asentado sobre la no consideración del suelo como “solar industrial”, dejando de lado elementos clave como los derechos de propiedad y el capital social. En definitiva, ha plasmado la no convergencia entre el “valor” de un terreno por su capacidad para poder desarrollar una actividad industrial, y el “precio” que debería tener como remuneración esa capacidad. En este artículo, se hace una reflexión sobre la situación vivida en Galicia desde el inicio de las actuaciones eólicas hasta el año 2008, para profundizar en la necesidad de establecer marcos normativos que contemplen los derechos de todos los agentes partícipes.
The development of wind power in Galicia was characterized, among other elements, by a “controversial” remuneration of the land occupied by wind farms. This controversy was based on the non-consideration of the soil as an “industrial site”, and by leaving aside key elements such as property rights and social capital. In short, it reflected the non-convergence between the “value” of a piece of land due to its ability to develop an industrial activity and the “price” that it should have as a remuneration for such capacity. In this article, a reflection is made about the situation experienced in Galicia since the beginning of the wind actions up to 2008, to deepen the need to establish regulatory frameworks that consider the rights of all the stakeholders involved.
