La supresión de la sustitución ejemplar y régimen transitorio

Abstract

El presente trabajo trata de analizar la eliminación de la sustitución ejemplar del Código Civil por la Ley 8/2021 en materia de discapacidad. Esta institución permitía a los ascendientes disponer mortis causa por sus descendientes incapacitados, garantizando un destino adecuado de sus bienes. La reforma la suprime por considerarla contraria al carácter personalísimo del testamento, sustituyéndola por una conversión en sustitución fideicomisaria de residuo, limitada a los bienes transmitidos gratuitamente por el ascendiente al sustituido. El estudio critica la solución adoptada, ya que genera problemas de interpretación en el régimen transitorio, afecta a la seguridad jurídica y desvirtúa la voluntad del testador. Además, plantea dudas sobre su eficacia en la protección de las personas con discapacidad, pudiendo incluso empeorar su situación sucesoria.

This paper examines the abolition of the sustitución ejemplar (exemplary substitution) from the Spanish Civil Code through Law 8/2021, enacted in the field of disability law. The former provision enabled ascendants to order, mortis causa, the succession of their incapacitated descendants, thereby ensuring the proper management and destination of their estate. The reform repeals this mechanism, deeming it incompatible with the strictly personal nature of testamentary dispositions, and replaces it with a conversion into a fideicommissary substitution of residue, restricted to assets gratuitously transferred by the ascendant to the substituted heir. The study critically assesses this legislative choice, noting that it gives rise to interpretative difficulties within the transitional regime, undermines legal certainty, and distorts the authentic will of the testator. Moreover, it casts doubt on the measure’s effectiveness in safeguarding the rights and interests of persons with disabilities, and may, in certain cases, even aggravate their position within the succession framework.
