Vivienda familiar e hipoteca en la sociedad de gananciales

Abstract

En el presente Trabajo de Fin de Grado se abordará el estudio de la vivienda familiar y la hipoteca en el seno de la sociedad de gananciales. Para ello, se comenzará acotando la institución de la vivienda familiar, subrayando su naturaleza y diferenciándola de otras viviendas de la familia. A continuación, se estudiarán las cuestiones relacionadas con la adquisición de la misma mediante préstamos garantizados con hipoteca, así como las previsiones legales y jurisprudenciales sobre el pago de las cuotas del préstamo sobrevenida la crisis matrimonial. Finalmente, se destacarán las medidas de protección de la vivienda familiar que articula el ordenamiento jurídico en sede de ejecución hipotecaria.In the present Final Degree Project the study of family housing and mortgage within the conjugal partnership will be discussed. For that purpose, family housing institution will be delimited, underlining its nature and distinguishing it from other residences of the family. Then, the issues related to the purchase of the family housing through loans secured by mortgages will be studied, just like the legal and case-law stipulations about loan fees payment once marital crisis occurs. Finally, the family housing protection measures laid down by law in foreclosure situations will be mentioned.
