A violencia contra a muller nos casos de subtracción internacional de menores

Abstract

A presente comunicación analiza o alcance que a violencia contra a muller ten nos casos de subtracción internacional de menores como motivo para denegar a súa restitución. Por un lado, á luz dos obxectivos do Convenio da Haya sobre os aspectos civís da subtracción internacional de menores e ao constatado paralelismo entre violencia de xénero e abuso de menores, deféndese que a devandita violencia debe ser causa suficiente para denegar a restitución do menor. Por outro lado, recoñecendo que é imprevisible que no panorama internacional se poida chegar a tal entendemento, avógase por unha interpretación do Convenio no seus xustos termos para que a violencia de xénero non sexa ignoradaThis paper analyzes the extent to which the violence against women is a reason to refuse returning the child in cases of international child abduction. Firstly, taking into account the objectives of the Hague Convention on civil aspects of international child abduction and the proven parallelism between gender violence and child abuse, we defend that the aforementioned violence must be a sufficient reason to deny returning the child. Secondly, as it is predictably difficult to achieve an international agreement on this topic, we stand for an adequate interpretation of the Convention in order to prevent ignoring violence against women
