Derecho de habitación de los legitimarios, el ajuste normativo: El artículo 822 del Código Civil

Abstract

El artículo analiza el alcance y los problemas derivados del artículo 822 del Código Civil, reformado por la Ley 41/2003 y posteriormente por la Ley 8/2021, en relación con la atribución del derecho de habitación a los legitimarios en situación de discapacidad. Este derecho pretende garantizar la continuidad en el uso de la vivienda habitual del causante, constituyéndose por legado, donación o por ministerio de la ley, y quedando excluido de la computación e imputación a la legítima. No obstante, la técnica legislativa empleada revela importantes deficiencias, al no clarificar cuestiones relativas a la convivencia, la necesidad asistencial, el orden de prelación de los legitimarios o la coordinación con otros derechos sucesorios, como los del cónyuge viudo. El trabajo pone de relieve las tensiones existentes entre la finalidad protectora del precepto y la seguridad jurídica, así como la necesidad de una reforma más precisa que dote de coherencia al régimen sucesorio en materia de discapacidad.

This paper examines the scope and legal challenges of Article 822 of the Spanish Civil Code, reformed by Law 41/2003 and later by Law 8/2021, regarding the attribution of a right of habitation (derecho de habitación) to forced heirs (legitimarios) with disabilities. The provision aims to ensure continuity in the use of the deceased’s habitual residence, either through a legacy, a donation, or by operation of law, and excludes this right from the calculation and imputation of the forced share (legítima). However, the legislative technique employed shows significant shortcomings, failing to clarify issues concerning cohabitation requirements, the concept of need, the order of succession among heirs, and the coordination with other inheritance rights, such as those of the surviving spouse. The study highlights the tensions between the protective purpose of the rule and legal certainty, stressing the need for a more precise reform to provide consistency in the succession regime concerning persons with disabilities.
