Bases de las obligaciones contractuales: función, contenido y utilidad

Abstract

El presente trabajo es un conjunto de reflexiones sobre las «bases de las obligaciones contractuales»; título competencial que el artículo 149.1.8ª de la Constitución reserva «en todo caso» al Estado y que sobre el que, tras cuarenta y seis años de vigencia del texto constitucional, sigue planeando la sombra del desconocimiento y la incertidumbre. A través de un estudio doctrinal y jurisprudencial, se busca arrojar algo de luz sobre una materia sin delimitar en un sistema de reparto de competencias en materia de legislación civil tampoco delimitado.This paper is a set of reflections on the «bases de las obligaciones contractuales». Article 149.1.8ª of the Spanish Constitution reserves this matter «in any case» to the State and a shadow of uncertainty remains over it after forty-six years of the enactment of the Constitution. Through the study of authors' opinion and case law, the purpose of this paper is to shed some light on an undefined issue in an also undefined system of allocation of legislative powers in the field of civil law.
