Cuestiones interpretativas en torno a la sustitución vulgar

Abstract

Las cláusulas de sustitución vulgar, de extendida utilización práctica, suscitan diversas cuestiones interpretativas en torno a sus presupuestos de operatividad, la determinación de los sujetos llamados como sustitutos y el alcance de su llamamiento. El presente trabajo trata de abordar tales cuestiones desde una perspectiva práctica, a través del análisis de la jurisprudencia y de la doctrina registral recaídas en torno a la debida interpretación de las cláusulas de sustitución, tarea presidida por la absoluta preeminencia de la voluntad real del causante.

Substitution clauses, which are widely used in practice, give rise to various interpretative questions regarding their operative conditions, the determination of the parties called as substitutes and the scope of their right. This paper attempts to address these questions from a practical perspective, through the analysis of the case law and the doctrine of DGSJFP on the proper interpretation of substitution clauses, a task presided over by the absolute preeminence of the real will of the deceased.
